Your Agreement with Painted Pixels
Terms of Service
Painted Pixels is a user-friendly platform for ordering Direct-To-Film (DTF) transfers, UV-DTF transfers, and custom apparel & accessories. When an order is placed through Painted Pixels—either directly on our website, via an integrated API, or through an approved e-commerce platform—we produce the custom products (“Products”) and ship them directly to our customers (“Customers”). Collectively, this process makes up the Painted Pixels Service (“Service”).
All use of the Painted Pixels Service, including any related plugins (“Application”) and paintedpixels.ca (the “Website”), is governed by these Terms of Service. The most up-to-date version of these terms is always available in the footer of the Website and Application.
The Application and Website are owned and operated by Painted Pixels, headquartered in Burnaby, British Columbia, Canada. By using the Painted Pixels Service, you agree to comply fully with the rules, practices, and policies outlined in these Terms.
Using Painted Pixels
To use the Painted Pixels Service, all members must agree to these Terms and Conditions. Users are required to provide complete and accurate information, including personal and payment details. You may opt out of receiving promotional marketing emails without canceling your agreement with Painted Pixels.
To register, new users must subscribe via the Website or Application and create an account. Each user is responsible for keeping their account details secure. Any breach or suspected compromise of credentials must be reported to Painted Pixels immediately. Painted Pixels is not liable for any losses resulting from lost, stolen, or unauthorized use of account credentials. Users may not access another user’s account, designs, dashboard, or information without explicit permission.
Painted Pixels may modify, suspend, or discontinue its Services, Products (including DTF transfers, UV-DTF transfers, and custom apparel & accessories), charges, or fees at any time. Painted Pixels also reserves the right to suspend or terminate access for individual users without notice or liability.
If not representing a business entity (such as a Corporation or LLC), users must be at least 18 years of age. By using the Painted Pixels Service, you certify that you are legally authorized to do so and accept full responsibility for your use of the Service. This agreement is void where prohibited by law or where access is otherwise restricted.
Changes To This Document
Painted Pixels, as the owner of this Service, may update or modify this agreement, including prices, policies, and terms, at any time. Users are responsible for reviewing any updates and adjusting their use of the Service accordingly. Continued use of the Painted Pixels Service constitutes acceptance of the revised Terms and Conditions.
Creative Content & Copyright Policy
All creative content (“Designs”), including but not limited to digital media, artwork, photos, text, graphics, logos, or other materials uploaded to the Service, must comply with the following:
- You must own the rights and/or copyrights to your Designs. If you are not the copyright holder, you must have explicit permission to use, reproduce, display, and sell the Designs.
- By uploading your Designs, you grant Painted Pixels a limited license to reproduce and print your artwork for production purposes, as well as to display it in our portfolio and marketing materials unless you request otherwise in writing.
- Your Designs must not infringe upon the intellectual property rights of other users, businesses, or entities. Painted Pixels reserves the right to review, remove, or restrict any content found in violation of these Terms or applicable laws and may suspend or terminate your account without notice.
To be clear: You, not Painted Pixels, are solely responsible for any Designs uploaded, reproduced, or sold through the Painted Pixels Service.
If you believe your intellectual property has been used without authorization on any platform or service owned or operated by Painted Pixels, please contact us with a notice of infringement.
Should legal action be taken against Painted Pixels due to a User’s infringement or actions, that User will be fully responsible for all legal fees, damages, and associated costs incurred in defending such claims.
Since Painted Pixels does not own the copyrights to your Designs or intellectual property, we will not distribute, resell, or share your Designs outside of the Painted Pixels Service.
Taxes
All orders are subject to applicable taxes, including any federal, provincial, or local sales tax rates in Burnaby, British Columbia, Canada.
Taxes are calculated as a percentage of the final retail price in accordance with Canadian tax regulations. When the retail price cannot be directly calculated, applicable tax will be assessed based on the governing tax rules.

Order Changes
Once an order has been submitted, it cannot be edited or canceled through the Website or Application. If you need to request a change, please contact us as soon as possible at sales@paintedpixels.ca
Refunds & Replacements
All replacement requests and “item not received” claims are subject to review and investigation by Painted Pixels.
Since our products are custom-made, we do not offer refunds. However, if a printing or production error occurs on our end, Painted Pixels will gladly provide a replacement. Please contact us within 30 days of delivery and include clear photos of the issue so our support team can assist you quickly.
Once an order has shipped, responsibility for any loss or damage transfers to the shipping provider (the “Carrier”). Customers must file claims for lost or damaged packages directly with the Carrier. Painted Pixels is not responsible for shipments that are lost or damaged in transit and cannot guarantee refunds, credits, or reshipments in such cases.
Payment & Fees
Painted Pixels may securely store a User’s payment information for future payments, shipments, or charges that must be applied to the User’s account.
By entering payment details into the Painted Pixels system, Users confirm that they are legally entitled to use the payment method provided and that they are either the cardholder or have explicit authorization from the cardholder to complete purchases.
The price charged will be the price quoted at checkout. Unless otherwise specified, all prices are listed in Canadian Dollars (CAD).
After completing a purchase, the Customer will receive a confirmation email including order details, pricing, product description, and shipping information. Full payment must be received before any order is processed.
Painted Pixels reserves the right to cancel orders at its sole discretion and may change, suspend, or discontinue products, prices, or promotions without notice.
Payments, charges, and invoices from Painted Pixels may appear on your account or card statement as “Painted Pixels.”
Account Creation & Data Storage
Guest accounts are temporary and typically remain active for 30 days. Because these accounts are not tied to a permanent email login, changes in your device, browser, or operating system may impact your ability to access your temporary profile.
We recommend all users complete full account registration to maintain consistent access.
It is the User’s responsibility to keep account login details secure.
Uploaded artwork files are tied to each User’s account and remain private. A copy of uploaded artwork is stored in our system and added to your design library.
While Painted Pixels does not currently restrict upload size or volume, we reserve the right to suspend or terminate accounts that misuse or abuse our file storage system.
Your data security is a top priority. However, due to potential changes in third-party platforms or storage providers, Painted Pixels cannot guarantee indefinite storage of artwork files. We strongly encourage all Users to maintain backup copies of their artwork.
Visitors Policy
Violations of the Visitors Policy outlined in these Terms of Service may result in termination of your User account.
Painted Pixels may remove artwork at its discretion, with or without prior notice, if it violates our policies or applicable laws.
Users accept full responsibility for all Designs uploaded to the Painted Pixels Service, including issues of copyright infringement, corrupted files, or incomplete submissions.
Users are also responsible for ensuring the accuracy of all information entered into the Painted Pixels Service, including product details and pricing.
If Painted Pixels incurs costs or losses due to inaccurate or incomplete information provided by a User (including, but not limited to, sales tax miscalculations), the User will be billed via their saved payment method.
Painted Pixels reserves the right to suspend or cancel accounts that create legal liabilities, violate our policies, or remain inactive and unused for extended periods.
Product Descriptions
The products, prices, and descriptions offered by Painted Pixels are updated regularly to reflect industry changes and product availability.
While we strive to accurately represent colors, mockups, and product details, final products may vary slightly from digital previews. Painted Pixels cannot guarantee 100% accuracy in product color or detail representation.
Purchase of Products
Submitting an order through Painted Pixels constitutes an offer from the User to Painted Pixels. The order is not accepted until Painted Pixels sends a confirmation email. Any Products not included in the confirmation email are not part of the order.
Orders must be placed through the Website or Application. Customers are responsible for ensuring that all details, including shipping information, are entered accurately to prevent delays or errors in delivery.
Delivery
In most cases, Painted Pixels will print and ship within two business days of receiving an order.
Once an item has been shipped, responsibility transfers to the carrier, and delivery dates become estimates only. While delivery is often faster, Painted Pixels cannot guarantee exact shipping times. In cases of significant delays, we will do our best to notify the Customer promptly.
Shipping prices are separate from product prices and may vary based on location or shipping requirements. Flat-rate charges are displayed at checkout, but Painted Pixels reserves the right to add additional fees for certain addresses or conditions.
Orders may be shipped in multiple packages and may arrive on different dates. Fulfillment and delivery will not begin until payment is received and processed in full.
Release
By using the Service, Users release Painted Pixels (including employees, officers, directors, agents, subsidiaries, and partners) from any claims, damages, or disputes connected to the use of the Service. Painted Pixels cannot guarantee delivery dates once Products are handed to the carrier and is not liable for losses of revenue or business due to cancellations, delays, or suspension of this Agreement.
Trademarks
The Painted Pixels trademark is the sole property of Painted Pixels. Users may not use the trademark, in whole or in part, as part of their own branding or in a manner that may confuse its relationship with Painted Pixels. Any reference to the Painted Pixels trademark must be accurate and clearly identify the connection to Painted Pixels.
Indemnity
Users agree to indemnify and hold harmless Painted Pixels (including employees, officers, directors, agents, subsidiaries, and partners) from any claims, demands, or legal proceedings (including reasonable attorney’s fees) arising from a User’s breach of this Agreement or violation of third-party rights.
Legal
In the event of a dispute between Painted Pixels and a User, we encourage resolution through our support team at sales@paintedpixels.ca
All claims or disputes against Painted Pixels will be governed by and interpreted under the laws of British Columbia, Canada. Any legal proceedings must be brought before the courts located in Burnaby, British Columbia.
General
This Agreement does not create any agency, partnership, joint venture, employment, or franchise relationship between Painted Pixels and Users.
You confirm you are authorized to provide any Customer information needed for order processing and shipping.
If any part of this Agreement is deemed invalid, the remaining provisions will remain enforceable.
Section titles are for organizational purposes only and do not affect the meaning of the Terms.
Failure by Painted Pixels to enforce any part of this Agreement does not waive our right to enforce it in the future.
Painted Pixels reserves the right to transfer or assign this Agreement, along with all rights under it, at any time.
